Terms of Use

BongGo is currently operated by Mr. Saptarshi Mondal, an individual developer based in India, and is not currently operated through a registered company. Mr. Saptarshi Mondal acts as the Data Fiduciary/Controller for personal data processed through BongGo, as described in our Privacy Policy. This structure may change in the future; any change will be reflected here and in the Privacy Policy.

BongGo welcomes learners of all ages. If you are under 18 years old:

• You may not create or use an account independently.
• A parent or legal guardian must sign in with their own Google account and complete our Parent/Learner consent flow before your learner profile is activated.
• Your parent/guardian may review, manage, or delete your data, or withdraw consent, at any time.

By using BongGo as an adult, or by completing the Parent/Learner flow as a parent/guardian, you confirm the age information provided is accurate.

BongGo uses Google Sign-In as its sole method of account authentication; we do not offer email/password or other login methods at this time.

• You are responsible for maintaining the security of the Google account used to sign in.
• You agree to provide accurate information during sign-up and the age gate.
• We may suspend or terminate accounts that violate these Terms.

BongGo uses Artificial Intelligence for:

• Voice-based pronunciation feedback and lessons
• Interactive educational responses
• Future AI video-based learning content

Important:

• AI responses are educational tools, not professional or certified instruction.
• AI outputs may not always be accurate or error-free.
• Pronunciation audio you submit is processed transiently and is not retained after feedback is generated (see Privacy Policy, Section 5).
• Users should apply their own judgment when relying on AI-generated content.

All content on BongGo, including lessons, text, audio, visuals, AI-generated educational material, logos, and branding, is the intellectual property of BongGo unless otherwise stated.

You may not:

• Copy, reproduce, distribute, or sell content
• Reverse-engineer or misuse AI features
• Use content for commercial purposes without written permission

If you submit feedback, messages, or learning inputs:

• You retain ownership of your content.
• You grant BongGo a limited, non-exclusive right to use it for platform improvement.
• We do not claim ownership over your personal learning data.

You agree not to:

• Misuse the platform or attempt unauthorized access
• Upload harmful, offensive, or illegal content
• Interfere with platform security or performance
• Use automated scraping or bots
• Attempt to bypass the age gate or Parent/Learner consent flow

Violation may result in suspension or legal action.

BongGo is currently provided free of charge, with no advertising. If paid features are introduced in the future:

• Pricing and subscription terms will be clearly disclosed in advance.
• Payments will be handled through secure third-party providers; we do not directly store payment card details.
• Refund policies will be stated at the time of purchase.
• These Terms will be updated accordingly, and material changes will be flagged for re-acceptance.

BongGo is provided "as is" and "as available," free of charge. We do not guarantee:

• Uninterrupted or error-free access
• Error-free AI output
• Specific learning outcomes

Learning progress depends on individual effort and usage.

To the maximum extent permitted by applicable law:

• BongGo is operated on a non-commercial, free basis by an individual developer, and is provided without any express or implied warranty of fitness for a particular purpose.
• We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the platform.
• Our total aggregate liability for any claim arising from these Terms or your use of BongGo shall not exceed the total amount, if any, paid by you to us in the twelve months preceding the claim (which, for a free service, is nil unless paid features are later introduced).
• Nothing in this section limits liability that cannot be excluded under applicable law, including in relation to our obligations as a Data Fiduciary/Controller under DPDP or GDPR.

You agree to indemnify and hold harmless BongGo and Mr. Saptarshi Mondal from claims, damages, or expenses arising from your violation of these Terms, misuse of the platform, or violation of any third-party right, to the extent permitted by applicable law.

We may suspend or terminate access:

• For violation of these Terms
• For misuse of AI features or attempts to bypass the age gate
• To comply with legal obligations

You (or your parent/guardian, if you are a minor) may stop using the platform at any time.

You may delete your account from the Settings page. When you delete your account, we remove your account profile and private learning data, including lesson progress, scores, XP, streaks, speaking practice records, and saved documents.

Some public interactions may remain visible after account deletion, including comments, likes, votes, or similar activity in public areas of the service. These interactions may no longer be associated with an active account.

We may retain a minimal deletion record, such as your deleted account ID, name, timezone, deletion reason, deletion date, and deletion method, for audit, security, abuse-prevention, and operational purposes. Parental and cookie consent records may also be retained in minimal form as described in our Privacy Policy.

Account deletion is irreversible.

For complaints regarding your account, these Terms, or data handling, please first contact our Grievance Officer as identified in our Privacy Policy. We aim to resolve grievances within a reasonable period, and no later than 90 days. If unresolved, you may escalate to the Data Protection Board of India or another applicable regulator.

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.

We may update these Terms from time to time. Material changes will be flagged as such and, where they affect your rights or obligations, may require re-acceptance before continued use. Continued use of BongGo after non-material updates constitutes acceptance.
